Know your wage and hour rights

If you are employed in Missouri, you and your co-workers may have questions about Missouri’s various wage and hour laws. At Hollingshead & Dudley, we believe that you deserve fair treatment and a hospitable environment in which to do your job.

Missouri’s wage and hour laws are set forth in Title 18 of the Missouri Revised Statutes and cover such things as the minimum wage, prevailing wage, overtime, meals, breaks, leaves and severance pay. Employers who violate these laws can face substantial fines and penalties. Should they violate the child labor laws, they also can be charged with a criminal misdemeanor.

Common wage and hour questions

As FindLaw explains, the hourly minimum wage in Missouri currently stands at $7.70. Despite proposed ballot initiatives to raise it, such measures are not yet on the November 2018 ballot. Missouri does, however, have a special minimum wage, called the prevailing wage, that varies by county and is applicable only if you are employed on a public works project such as building a road, bridge or a state or local government building.

Missouri employers are required to pay you overtime if you work over 40 hours per week as opposed to over eight hours per day. The overtime rate is 1.5 times your regular pay rate. As for meal and break times, Missouri employers are not required by law to provide them to you, although many employers do so voluntarily.

Missouri employers also are not required to give you vacation pay, holiday pay or sick leave. Again, many employers do so voluntarily. The Family and Medical Leave Act may apply in some situations.
